The owner has determined that Adams County operated a small County landfill  from 1971 to 1976 when it was closed and covered. It is the owner's understanding that only household waste was deposited. The owners have retained GSI Engineering, LLC, a reputable and established environmental consulting firm, to conduct a Phase I Environmental Site Assessment consistent with the technical scope and objectives prescribed by American Society for Testing and Materials (ASTM) E-1527-21 Standard Practice for Environmental Site assessments standards. The buyer of this property takes free of liability as a bona fide prospective purchaser after the Phase I Environmental Site Assessment is completed and delivered prior to closing the purchase.

Terms:  A payment equal to 10% of the purchase price will be due the day of the auction.  The balance will be due on or before December 20, 2024, by certified funds, or a direct wire transfer to the closing agent.  The 2024 and all prior taxes will be paid by the sellers.  The buyer will be responsible for all subsequent taxes.  Title insurance will be split equally between the buyer and the seller.  The sellers will convey fee simple title subject to any existing highways, easements, reservations, or encumbrances of record on file with Adams County Register of Deeds.  All equipment and improvements sell in “as is” condition. 

 

Possession:  Full possession for the 2025 crop year will be granted. The current tenant has the right to remove the corn from the bins until August 15, 2025.  The tenant is responsible for the electrical use on the bins until the corn is removed.

 

Auction Method:  Any absentee bids or bidding on behalf of another person or entity must be approved by Ruhter Auction & Realty, Inc and the sellers.
